<p>The documents we received  emails, briefing documents and powerpoint presentations  are heavily redacted and still fail to provide any specific detailsincluding technical details  on the purported surveillance problems the government claims require expanding the law. Earlier this month the FBI, DEA and the Department of Justice Criminal Division responded to our FOIA litigation for records related to the Department of Justices controversial efforts to push Congress to expand the Communications Assistance to Law Enforcement Act (CALEA).1 Although the agencies stated in their court filings (here, here, and here) that they had thousands of pages of records, so far they have only turned over a few hundred pages (and the DOJ Criminal Division has yet to give us any documents).</p>
<p><span id="more-4449"></span>
<p>For example, several emails discuss a company or companies that may not be complying with intercept orders (see, for example, EFF/Lynch 25-26, 29, 33 and 402). For example, a slide titled Challenges and constraints faced by Law Enforcement (EFF/Lynch 76) is almost completely blank. This is also true for several presentations we received, as well as a counterintelligence memo sent to 13 branch offices. And all pages of the counterintelligence memo, which cryptically mentions a VoIP provider that could be Skype, are either almost completely redacted or withheld in full. (see EFF/Lynch 275-285). While several emails and slides discuss at a high-level the problems the bureau is facing, the FBI has still withheld important information that would flesh out the details of these problems. However, the FBI has redacted important information about the problems it has faced and the name(s) of the compan(ies) involved. Similarly, the recent examples section of several slides titled Legislative and Policy Challenge (EFF/Lynch 95-102), has been blocked out (see example above).</p>
<p>In at least two of the redacted presentations released to EFF, the FBI appears to have provided the documents in their entirety to organizations outside the federal government, raising the question of whether the Bureau properly withheld the information in its release to EFF. These include a presentation to the National District Attorneys Association in April 2010 (EFF/Lynch 85) and another to the Association of Prosecuting Attorneys at the 6th National Community Prosecution Conference: The 21st Century Prosecutor. (EFF/Lynch 131-137). Several of these slides were redacted partially, while several more were withheld in fulldespite the fact that it does not appear these conferences were closed to the public.</p>
<p>For three separate documents, the agency has only included the cover page, including a whitepaper from July 2008 titled Going DarkLaw Enforcements Need to Preserve Lawful Interception Capabilities (Going Dark 1443) and two attachments to a redacted document titled The Going Dark Initiative that discuss specific legislative proposals in response to the Going Dark Problem. (see Going Dark 146) In each case, all pages that might possibly explain the FBIs rationale and need for Updating and Improving Federal ELSUR [Electronic Surveillance] Laws and Assistance Mandates have been withheld in full. (see Going Dark 147-148). The documents FBI released recently in response to our Going Dark FOIA request are even less informative.</p>
<p>In Operation Achilles the FBI broke up an international online child porn and exploitation ring in 2008 that used anonymizers and encryption services to conceal their activities. And in a cocaine bust that suffered from electronic surveillance problems creat[ing] delays and prevent[ing] the interception of pertinent communications, the agency was still able to obtain an indictment. It doesnt appear from the records we have received so far (at least from the parts that arent redacted) that the agency has been crippled by the Going Dark Problem or that the bad guys have gotten away.  (EFF/Lynch 130). In fact, in the two concrete examples not fully redacted (and these are the same examples FBI Director Mueller used to justify his call for expanding CALEA in an October 2010 speech) the agency was ultimately successful.</p>
<p>Without any specific details about the agencys claimed problems trying to execute intercept orders, Congress and the public should be wary of any claim that expanding CALEA to apply to additional electronic communications service providers is an appropriate solution to the FBIs supposed &#8220;Going Dark&#8221; problem. The records we have received fall far short of justifying any amendment to CALEA, much less the broad expansion the Department of Justice appears to be seeking.</p>

<p>The new server performance standard, launched by the Underwriters Laboratories (UL) (the big electronics certification and testing organization) is calledUL 2640 and it&#8217;s based on Power Assure&#8217;s technology, called PAR4. The PAR4 metric is meant to measure server power consumption in various ways, including monitoring idle power, peak power, total utilization power, and transactions-per-watt.Basically, PAR4 enables servers of different makes, models and generations to be compared to one another in terms of energy efficiency.</p>
<p><span id="more-4426"></span>
<p>The Underwriters Laboratories tests new servers for safety, and will be including testing of new servers&#8217; UL 2640 ratings based on PAR4. That should help the metric be incorporated in new servers coming to market from multiple manufacturers, Power Assure CEO Brad Wurtz told us in an interview last week.</p>
<p>The main problem, as Wurtz described it, is that many server makers tend to publish specifications for their servers that overstate how much power they need at a maximum power draw. That&#8217;s how data center managers get fired. Theres a reason for this: Server makers dont want data center operators to try to run too many servers off one rack or power supply, only to see a surge in power use blow circuits or damage equipment.</p>
<p>But overestimating energy consumption for servers also means data centers are often under-utilizing their available power per rack, row or section of the data center. One of the key benefits of Power Assures software is to measure and establish a true power use maximum for the servers in the data center, then allow data center operators to fill in their racks to get the most computing power-per-watt available. This ultimately enables data center operators to know exactly how far they can push their existing servers when they need them.</p>
<p>The idea is to add capacity planning, management and forecasting abilities to data center operators existing set of tools to manage the interplay of server power use with data center facility systems, such as chillers, air handlers and other equipment. Beyond getting the PAR4 metric out into the world, Power Assure is launching a new set of analysis tools to complement its existing lines of power management and automation software.</p>
<p>For example, San Francisco-based Sentillas software tracks and manages server power use across both physical servers and servers that have been virtualized. There are tons of companies working on similar platforms to measure and manage data center power, at the server level, the IT equipment level, and the overall building level.</p>
<p>On the building side, Folsom, Calif.-based SynapSense monitors temperature, humidity, power use and other factors in data centers to fine-tune equipment operation to the needs of individual server racks and rows. San Francisco-based Modius pulls together different building systems into a single database and automation platform. Startups like Viridity Software and Racktivity are tackling server and facility energy management in different ways.</p>
<p>SynapSense has a strategic relationship with &#8212; and investment from &#8212; General Electric, while Power Assure has landed an investment from Swiss power giant ABB, and recently demonstrated interoperability with ABBs data center automation technology. Many of these data center players are forming partnerships with giants in their fields.</p>
<p>Data centers are now consuming around 2.5 percent of the U.S. Whether data center operators will embrace the power per server metric &#8212; and Power Assure&#8217;s software &#8212; remains to be seen. electricity supply, and the EPA projects data center power use will double by 2015 to add up to $7.4 billion in annual power bills. But one things for sure: data center energy efficiency is becoming a key issue.</p>
<p>No doubt there will be plenty of other green data center innovation on display at the show. Power Assure will be showing off the new software at the Uptime Institutes Symposium 2011 conference this week in Santa Clara, Calif. We have reorganized the way to market our intellectual property.The University is taking an active role in creating new businesses, evaluating technology, building the company&#39;s vision, and find investors. Our goal is to become an active participant in the creation of new enterprises in the work of our universities. </p>
<p> It feeds the rest of education throughout the state of ecosystems, the production of teachers who teach in secondary schools and regional community, and strengthen education K-12 teachers who are well equipped to prepare students for future challenges. <p>The ruling is the second in as many weeks granting employers boundless power over their employees&#8217; computer use. A different federal appeals court said employees could be prosecuted under a federal hacking law if they access information on a work computer that they were entitled to, and use that data in a manner violating company policy &#8212; such as to set up a competing business.</p>
<p>So the district installed monitoring software on the computer, and found that Zellner had searched &#8220;blonde&#8221; on Google and terminated him. In the teacher case, the Chicago-based appeals court said Thursday that the Cedarburg School District suspected the Cedarburg Education Association president might have porn on his computer after the biology teacher reported his computer had &#8220;gone crazy&#8221; in 2005.</p>
<p>&#8220;It is undisputed that the search violated the districts policy, that Zellner admitted that he performed the search, and that he knew he violated the policy. &#8220;While it is abundantly clear that the relationship between the union and the district was contentious, combative and miserable, and that Zellner and the district played a central role in the relationship, Zellner ignores the discovery of his Nov. 6 Google image search,&#8221; the appeals court ruled. Accordingly, the school board had a legitimate,nondiscriminatory reason to terminate Zellner&#8217;s employment&#8221; (.pdf).</p>
<p>Why is the burden placed on the employee? Maybe I should sue my employer for not having a porn firewall up that blocks me from accidentally coming across NSFW web content! Force all employers to put safeguards on every workstation their employees use to prevent these &#8220;computer-use violations.&#8221; When my supervisor has to type in his passcode in order to allow me to access a search engine like Google, or to access my Outlook address book to send an email to a client, and my productivity drops to ZERO, maybe the Supreme Court justices will come back to their senses. The remedy to this is simple.</p>
<p>(tracking data was harder to assemble then).  They had us drop everything for a week to get all this stuff.  Like I said, selective is the right word.  Huff puff, meeting after meeting till they found out who it was&#8230; then it went silent was swept under the rug and not spoken of again. Back in the late 90&#8217;s I worked in IT for a transportation company (I won&#8217;t mention which one, but they have their own golf tournament) two weeks in, there was in incident of porn (not playboy kind) that popped out of a printer on the exec floor.  One of the female execs was standing there when it happened.  One big poop storm later they wanted print logs from all the print servers, firewall logs&#8230; etc.</p>
<p> DUH. here is a new one, take  your laptop with wireless internet to school that way when you google anything that might even remotely be construed as &#8220;grounds for termination&#8221; it is not on the WORK computer.  or hey try this, go to the library and look at a book. Then if something does appear on your computer that might be objectionable then it is just that on YOUR computer.  And hell, with all the smart phones in the world use one of those for searching. You know those things with pages in them.</p>
<p>I think Google account settings save whatever your safe search preferences are from when you last changed it, so if you logged into your Google account (which I believe Google does automatically when you log into Gmail) from your work computer, and then forgot to logout before doing a search, you&#8217;re likely to get an eyeful of NSFW links and pics if you turned safe search off at home.</p>
